North Carolina Rep. Sue Myrick is a co-sponsor of the bill HR1220. The bill would essentially legalize product based pyramid schemes, and is inappropriately named the "Anti-Pyramid Promotional Scheme Act of 2003". from Channel 6 The Amway/Myrick connection was revealed in a motherjones.com article. Amway contributions to Myrick's campaign constituted the largest single soft money donor to any campaign (House or Senate) in the 1994 congressional elections! More than Enron or its lawyers (Vinson & Elkins), more than any bank or investment house contributed to any single campaign. Despite the fact the Mrs. Myrick said that The main point of contention for a product-based pyramid is the percentage of products moved to retail customers (non-participants in the compensation scheme). The requirement that a majority of sales be made to non participants of the compensation scheme is needed to ensure a MLM has competitive products that serve retail customers. Without this requirement, anyone could start a pyramid scheme by selling worthless or overpriced goods, using the overpayment as the entrance fee to participate in the pyramid. The Omnitrition MLM was shut down for being an illegal pyramid since the majority of sales were only to the scheme's participants. Id., 177 F.3d at 481. Indeed, the Sixth Circuit noted that the payment of money that is unrelated to sales of products to retail customers is the sine qua non of an illegal pyramid scheme under the Koscot test. Id. at n6 (citing Omnitrition). Quixtar has openly taken exception to the Omnitirition precedent about "personal consumption" by claiming the 70% rule can be fulfilled by self-consumption from distributors. The HR1220 bill specifically mentions the Omnitrition ruling, and is designed to override the existing precedent. "(4) The Ninth Circuit Court of Appeals erred in defining a pyramid promotional scheme in Webster v. Omnitrition Int'l, Inc. (79 F.3d 776; 9th Cir. 1996)." Since Myrick has been the recipient of hundreds of thousands of dollars in contributions from Amway/Quixtar distributors, it is no wonder she is a co-sponsor of HR1220. The bill is also backed by the Direct Selling Association (DSA), of which Amway/Quixtar is a member. Myrick was appointed to the House Committee on Energy and Commerce on January 28, 2004. This is thee same committee that will consider HR1220. Will the law get changed before Quixtar is finally challenged by the regulators to be an illegal pyramid scheme using the Omnitrition precedent? |
