Nitro Case claims dismissed |
| The remaining claims in the 2003 Federal suit against Amway/Alticor/Quixtar,
otherwise known as the "Nitro"
case involving the tools businesses of Double Diamond Brig Hart, Crown Kenny Stewart, and
Diamond Charlie Schmitz were finally thrown out of court on Feb. 8, 2004. The
claim of "racketeering" was thrown out several months ago. After about 3 1/2 years of litigation of first the validity of the arbitration agreement and judge Dorr's stunning opinion that the Quixtar arbitration agreement was "unconscionable". Most of the latest documents are sealed so it will be tough to see what evidence and arguments were presented to get Judge Door to thrown out the claims with pre-trial motions. |
