| You have to love the IBOAI's double standards. Apparently the most sure
fire way to harass your critics these days is to use potential violations of the
copyright law, and the IBOAI and their lines of sponsorships have no problems using this
tactic against their critics. On May 2, 2006 I received a letter from the IBOAI's attorneys, McGarry Bair to cease and desist using one photograph from the IBOAI website on my page "Does the IBOAI have ties to Qrush". Obviously the IBOAI and Mr. Joel Bair prefer not to acknowledge the Fair Use provision of the copyright law. I know the provision exists but I also learned it is a defense that can only be used close to the end of the litigation process. Basically it gives the right to still hire an attorney. I complied with their request to remove the photo because it was not worth it to me to push the issue of Fair Use. The IBOAI and the Quixtar diamonds now show their true colors with "do what I say, but not what I do". The IBOAI in hypocritical form has copied in full three complete pages from my site, for which I own the copyrights since I am the author. On June 16, 2004, the IBOAI reproduced and distributed without my express permission my materials on their website! Can you believe the nerve the gall of the IBOA!J LOL! The are doing same thing they accused me of doing, and which they outlined could cost me $30,000 per infringement and up to $150,000 if it were intentional! I wonder how they would respond if I sent them a similar "cease and desist" letter? On one hand the IBOAI and the Quixtar diamonds expects its critics to respect their copyrights, but on the other hand the IBOAI copies and intentionally displays material, which does not belong to them. |
